Terms & Conditions of Service

Please review these terms carefully before accessing or purchasing through Healthways Store (healthways.store) or utilizing our Local Society Healthcare Ambassador network.

Acceptance of Terms

This document constitutes an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder. By creating an account, browsing the catalog, uploading prescriptions, or purchasing products on Healthways Store (`healthways.store`), you irrevocably acknowledge and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must refrain from using the platform.

1 User Eligibility & Account Responsibilities

  • Age Requirement: You must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872. Minors may only procure wellness items under the supervision of a parent or legal guardian.
  • Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, login passwords, and OTPs. Any transactions or orders initiated through your account credentials shall be deemed authorized by you.
  • Truthful Information: You agree to provide true, accurate, and current personal, shipping, and medical details during checkout.

2 Prescription Medication Rules (Schedule H & H1 Drugs)

In strict compliance with the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945:

Mandatory Valid Prescription: No prescription medicine (Rx) will be dispensed without a valid written or digitally signed prescription issued by a Registered Medical Practitioner (RMP) bearing the doctor’s registration number, clinic address, patient name, date, and dosage instructions.
Pharmacist Verification: Every uploaded prescription is reviewed by our licensed registered pharmacists. We reserve the absolute right to reject orders if the prescription is found to be expired, blurred, altered, or issued for narcotics/habit-forming drugs without necessary psychiatric permissions.
Substitute Policy: When exact branded medications are out of stock, our pharmacist may contact you to suggest an exact bioequivalent generic formulation with identical active pharmaceutical ingredients (API) and strength, subject to your verbal or written consent.

3 AYUSH Formulations & Traditional Wellness Products

All Ayurvedic, Siddha, and Unani products hosted on Healthways Store are sourced from manufacturers holding valid AYUSH Manufacturing Licenses and adhering to Good Manufacturing Practices (GMP) under Schedule T of the Drugs and Cosmetics Rules. Information provided on classical Rasayanas, herbal churnas, and dietary supplements is for educational guidance and does not replace personal clinical diagnosis by an Ayurvedic Vaidya or physician.

4 Product Pricing, Invoicing & Electronic Billing

  • Maximum Retail Price (MRP): Prices listed on the platform never exceed the statutory Maximum Retail Price printed on the manufacturer's packaging.
  • GST Inclusive: All product prices include applicable Goods and Services Tax (GST). Formal tax invoices showing GSTIN breakdown are issued with every delivered consignment.
  • Price Variations: While we endeavor to ensure 100% price accuracy, manufacturers periodically update batch MRPs. If a batch price differs, our care team will notify you prior to dispatch.

These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any legal dispute, arbitration, or proceeding arising out of or in connection with this platform shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
